KAJIAN KRIMINOLOGI TERHADAP PELAKU TINDAK PIDANA PENYEBARAN VIDEO BERMUATAN PORNOGRAFI DI MEDIA SOSIAL WHATSAPP SEBAGAI TINDAKAN BALAS DENDAM (REVENGE PORN)

Abstract

Teachers should conduct with high moral standards since they serve as role models for their students. Information and communication technology development is essentially like a double-edged sword because it can affect social life in both positive and bad ways. The case study decision number for the criminal investigation of those who distributed pornographic videos on WhatsApp as a form of retaliation is 173/Pid.Sus/2022/PN Cms. This case involves the distribution of pornographic videos made by an individual who was not only the distributor but also the performer in the pornographic video. The research conducted by the author was limited to determining the factors that led the perpetrator to distribute videos containing pornography as a form of revenge, the harm that the perpetrator caused, and the steps taken by law enforcement to stop the distribution of pornographic videos as a form of revenge (Case Study Decision Number: 173/Pid.Sus/2022/PN Cms). The approach method used in this research is normative juridical with data collection techniques using library study methods (Library Research) and field studies (Field Research). The descriptive analytical research method is a way to solve the problems being faced using data collection, data classification, and data analysis, which will later be collected with the aim of creating a picture of an objective situation. Economic motivations, as well as considerations involving retaliation and pain, are the main causes of illegal acts of revenge porn on social media, according to data gathered from research and conversation. Both the environment and the victims suffer as a result of this. Preventive and repressive measures are what the authorities are trying to accomplish. The author suggests that in order to successfully resolve cases of revenge pornography, there should be good cooperation between all parties. Law enforcement officials are also expected to be able to provide sufficient punishment for criminal acts of revenge pornography on social media (revenge porn), which can provide a deterrent effect to perpetrators. Public awareness, outreach, and education programs must be strengthened.
